Telecel lifeline: Court nullifies licence cancelation

The High Court of Zimbabwe has granted Telecel Zimbabwe an interdict preventing the Postal and Telecommunications Regulatory Authority of Zimbabwe (POTRAZ) from effecting the cancellation of its operating licence pending an appeal to the Minister of Information Communication Technology, Postal and Courier Services, Supa Mandiwanzira.

High Court Judge, Nicholas Mathonsi ruled that the matter was urgent, adding that the regulator, POTRAZ, was overzealous in the cancellation of the mobile operator’s licence.

Gerald Mlotshwa of Titan law firm, who was representing Telecel, highlighted the urgency of hearing the case before the 28th of May owing to the amount of people who will be affected by the cancellation of the licence.

Telecel approached the High Court of Zimbabwe yesterday seeking the prohibitory order.

\n

Under the Postal and Telecommunications Act, the company can appeal to the Minister within 30 days of the cancellation of the licence and can also approach domestic courts if not satisfied with the outcome of that appeal.
